Common questions

How is gratuity calculated in the UAE?

You get 21 days of basic salary for each of your first 5 years, and 30 days of basic salary for each year after that. Part years are counted pro rata. One day's pay is your basic monthly salary divided by 30. The total can't be more than 2 years of basic salary.

Do I get gratuity if I resign?

Yes. Under the current UAE labour law (Decree-Law 33 of 2021) there is no cut for resigning. If you have worked at least 1 full year, you get the full amount.

Is gratuity calculated on my full salary?

No. Only your basic salary counts — not housing, transport or other allowances. Check the basic salary written on your contract or payslip.

When must my employer pay my gratuity?

Within 14 days after your contract ends, together with your other final dues. If you are not paid, you can complain to MOHRE on 600590000 or through the MOHRE app.

Do unpaid leave days count?

No. Days of unpaid leave or absence are not counted in your years of service.
